Three Kitzmiller Coal Miners Begin Terms For Rioting
Get Six Months Each In House Correction
Three Kitzmiller miners, who were convicted at the September term of Garrett County Court and sentenced to six months in the House of Correction for rioting, began their terms last week, when removed from the Oakland jail by Sheriff Juniper Teets.
The men, Robert Smith, Ed Helmick and Woodrow Wilson, were charged with being involved in picketing and rioting near Grantsville during the coal strike last Spring, at which time John Keister, a mine operator was badly mauled. Tried in Garrett County Court, the three were found guilty of rioting and sentenced by Chief Judge William A. Huster and Associate Judge Walter Capper to serve six months each.
Appeals were noted by their attorney, and the men were released under bond When the term of court just ended convened, the men appeared in Court, and were informed that their appeal had not been perfected, and necessary written testimony and other papers had not been filed. This voided their appeal, and Associate Judge George Henderson at the request of the prosecuting attorney, asked that they be confined.
The court ordered them removed to the county Jail and Sheriff Teets took them last week to the House of Correction to serve their sentences. At the trial it was testified that several car and truck loads of men from Kitzmiller and vicinity, all allegedly members of the United Mine Workers, went to the Grantsville section in an effort to close the mine which was a non-union operation and had continued production. The alleged riot resulted.
