Note: Caspar Boberg came over on the ship "Atlantic" from Bremen and Southampton to NEW YORK on 9/26/1866. He was a 22 yr old male and a "joiner". He was not in the Pa census of 1870, although he is in the Pittsburgh city registry of 1870.... He emigrated from Sutthausen, Osnabrück, on August 6, 1866...along with Johann Heinrich HUNE, 17 years old, and Johann Heinrich BOLTE, 24 years old. The date of his intention was 3/11/1872, and his naturalization was 10/4/1876 in Allegheny County in Pittsburgh. Sponsor was Henry Schmidt, who also sponsored George Kratz, a German whose date of intention was 11/7/1874 and naturalized 9/24/1878, and also Andrew Miller (DI 5/29/1876, Nat: 9/2/1878) and Geo Walther (DI 11/4/1872, Nat: 10/28/1878). ------------------ His death notice: "BOBERG, Casper -- On Wednesday, April 28, 1915, at 8:20 p.m., Casper Boberg, husband of the late Elizabeth BOBERG (nee MEISNER), in his 72nd year. Funeral from his late residence, 5109 Duncan Street, Tenth ward, on Saturday, May 1, at 8:30 a.m. Solemn requiem mass at St. Augustine's Roman Catholic Church at 9:00 a.m. Friends of the family, Knights of St. George of Branch No. 5, Holy Name Society, Men's Conference and Poor Souls Society are respectfully invited to attend. First: It is my Will and desire that all my just debts and funeral expenses be paid by my Executor hereinafter named and that he settle my estate as prompt and economically as possible. Second: I give devise and bequeath to my two daughters Cecilia and Hildagard Boberg all my household goods, including furniture, pictures and ornaments in, about or belonging to the house where I ay reside at the time of my death, each share and share alike to have and to hold the same to themselves, their heirs and assigns forever, generally, absolutely and in fee simple. Third: I give devise and bequeath to my Daughter Theresia intermarried with Richard Rinscheid, the sum of One Hundred Dollars. Fourth: All the remainder of my estate be the same real, personal or mixed or wheresoever situate or wheresoever found I give devise and bequeath the same to my three children, each share and share alike to wit: To my Son William Boberg the one-third part, to my Daughter Cecilia Boberg the one-third part, to my Daughter Hildegard the one-third part, to have and to hold the same to themselves their heirs and assigns forever generally, absolutely and in fee simple with full power to dispose of any or all my real estate the same as I might do if living. Fifth: And Lastly I do hereby nominate, constitute and appoint my son William Boberg the sole executor of this my Last Will and Testament and guardian of my minor children. BOBERG, sworn. I am executor of the estate of my father, Casper Boberg, who died April 29, 1915. Letters granted May 4, 1915. My mother died May t, 1906. Copy of will, Exhibit No. 1, offered in evidence. I have collected all assets and paid all debts. The will bequeaths the household furniture to my two sisters Cecilia and Hildagard Boberg, which w complied with and the furniture turned over to them. The $100, legacy has been paid to my sister Theresia, intermarried with Richard Rinscheid. All the parties are of full age. Cross-examination by Mr. Johnston: Q. You collected the sum of $214.35 from the Metropolitan Life Insurance Company? A. Yes sir Q. You don't include that in your account? A. No, I didn't, for the reason, if I am requested, the amount my father carried a policy in the Knights of St. George for $1000. and I was the beneficiary. Mr. Johnston: We object to any policy of the Knights of St. George. A. (The witness): For none moment you asked me to state my reason and I am here to do it. $1000. from the Knights of St. George, and there were four of us living and one sister Theresia, intermarried with RIchard Rinscheid was shut off with $100., and when this policy was made for $1000. and I was beneficiary, I promised my father on his death bed I would take care of my two sisters and we are living together and I agreed with my two sisters that the Metropolitan, since there is no beneficiary, we throwed that in bulk! and divided that equally between my two sisters, and that is the reason I have not accounted for it. Mr. Lippert: Q. Mr. Boberg, you saw the policy of the Metropolitan Life Insurance Company? A. I have. Q. And was there any beneficiary? A. No beneficiary mentioned. EXCEPTANT'S CASE: J. A. Wilson, sworn. I am in the life insurance business as managed for Metropolitan Life Insurance Company and as such conducted the settlement with Mr. Boberg, the last witness. On or about May 15th, I paid him $214.35, for which I have the check, Exhibits 2 and 3 being photographic copies. I also have the policy upon which this claim was made, and Exhibit 4 is a photographic copy Also I have the application is this case and Exhibit No. 5 is a photographic copy of it. Clause 9 of the application relates to the party beneficiary. Mr. Johnston: I offer in evidence Exhibits 2, 3, 4, and 5. Mr. Johnston: Q. Who is named as beneficiary in the application for insurance? Mr. Lippert: I object to that going in evidence for the reason that at the time of the writing of insurance was not considered a part of this policy by stature and there is an act since that making the application a part of the policy. By the Court: That act can only be called into play by the insurance company. Mr. Johnston: I offer in evidence Exhibit No. 5, being a photographic copy of the application in this case in which the name of Elizabeth Boberg, wife of the applicant is named as beneficiary. Cross examination by Mr. Lippert: Q. What was the purpose of the application at the time of writing this policy? Objected to, the paper itself shows that. By the Court: Answer this question, Mr. Wilson. A. Writing it so that the policy might issue. Q. Was there any other beneficiary named after the death of Elizabeth Boberg? A. No sir. Q. Mr. Wilson: what were the premiums per week under this policy? Objected to as immaterial. Objection sustained. Mr. Lippert: Then, your Honor please, I will object to the exceptant at this time questioning the distribution of this estate because the proper channel by which to administer the Elizabeth Boberg estate would be by citation to the oldest son, who would have the first right to administer under the mother's estate and not making at this audit for a distributi! on of another person's estate. By the Court: Do you admit, Mr. Lippert, that the money was properly paid to the accountant as administrator? Mr. Lippert: I don't unless the fifth clause of the policy would cover it. WILLIAM J. BOBERG, recalled. Examination by Mr. Lippert: Q. What premiums, if you know, were paid and how often paid on this policy? Objected to, first, because it is irrelebant (sic), and second the competency of the witness, the other party being dead. By the Court: The second objection is sustained. J. A. WILSON, recalled. Examination by Mr. Lippert: Q. Mr. Wilson, I show you photographic copy of policy Exhibit No. 4. Can you determine from that photographic copy of the policy how much premiums were paid and when? Mr. Johnston: We renew our objections that it is irrelevant. By the Court: The policy speaks for itself, objection sustained. Mr. Lippert: We make claim of amount of premiums paid since the death of Elizabeth Boberg, January 24, 1905. By the Court: The exceptions will be sustained and the executor surcharged with the amount of the insurance policy collected by him, and distribution made.
