 His father was Jacob Waller, born June 22, 1783 and died July 4, 1838 in North Carolina. Burton's grave is not marked, buried with second wife Elizabeth (Betty) Blackshear Waller. His children with first wife Melcha Dennis are: Jacob, John (±1836 - ±1854), Samuel (±1839 - died as a infant) Mary, Lucy (±1842 - died as a infant) Emmaline Mason Ann (married Robert William "Billy" Pattison; died in 1896), Luther, daughter Vise Ellen (1848 - 1852), and twins Charles Burton and Elizabeth Victoria Wineford. Family history says his brother Luther Sanders Waller and he came from North Carolina together to then-Henry County, AL (counties were redrawn in early 1900 to make the area now in Houston County) for logging jobs, and that, after Burton died from pneumonia after falling into the Chattahoochee River while logging, Luther went back to North Carolina. Some online history of this family does not show a brother named Luther Sanders Waller. Some records show Burton coming from Kingston (now Kinston), NC, but others say he came from Craven County. Family history does say he was born in neighboring Craven County instead of Lenoir County.
 Daughter Emmaline is discussed online by a family member,
 here and in another posting at this URL . After his first wife died, he married Elizabeth "Betty" Blackshear on December 28, 1852 and had one son: Benjamin. His death, noted above, occurred before this son was born and Betty raised his children.

Burton Waller was a farmer and logger by trade having come from Georgia where the farmland was playing out and timber was hard to find. In the spring of 1853, after the arrival of a late cold front, he was on the Chattahoochee River moving logs. The water was very cold when Burton slipped and fell in the river. He contacted pneumonia and died on March 12, 1853. He is buried in Camp Springs Cemetery. Henry County, Alabama.
