  Mary was the daughter of Major James Hayes, a Justice of the Inferior Court, prominent planter, and land owner of Clarke County, Georgia. By 1819 James Hayes had moved to Burnt Corn, Monroe County, in the Mississippi Territory (Alabama). He later lived in Dallas County in the same state. James was the son of Patrick Hayes, a Revolutionary War veteran.
