Amarillo Globe-News, April 12, 2009 Burial: Llano Cemetery Amarillo, Potter County, Texas, USA Plot: Section 20 Lot 59 Space 1H --------------------------------------------------------------------------------------------- Deposition for lawsuit Amarillo, Texas 6 Sep 1946 My name is Mrs Margaret Howren Burlingame. I am 28 years of age and the widow of Ronald Bythe Burlingame. We were married 1 Jun 1942. The marriage took place here at the residence of my parents, 800 Florida St. We have two children, Robert Stevens, born 17 Oct 1943, and Raymond Nelson, born 28 Jun 1945. My husband was 30 years of age at the time of his death. His mother, Mrs Cora May Eubank, was killed in this same accident, while his father, Harry Edward Burlingame, was killed about two months ago in a railroad accident. My husband had not been previously married and of course, had no other dependents besides myself and our two children named above. Our marriage license was obtained here in Potter county, Texas and name is on record. I have never been married before. I am pregnant at this time and am expecting another child about Jan 1947. On Sunday, 18 Aug 1946, my husband, Robert Stevens, Mr and Mrs J J Eubank and their child Norma Jan, left Amarillo to go to northern New Mexico on a vacation trip. They went in our 1931 model Pontiac Fordor Sedan. They had planned on being away for two weeks. Howver, it became rainy weather and they decided to come home on the night of Aug 22-23rd. Enroute home the car was involved in an accident on the Raton-Clayton Highway, and in the accident my husband was killed, Robert Stevens injured seriously, Mrs Eubank was also killed and Mr Eubank and Norma Jan was injured. The car was demolished. Robert Stevens sustained fractures to both legs and a severe cut on his head. He is under the care of Dr Jason Robberson. My husband was a mechanic by occupation, but was not employed at the time of his death. During the war he worked as an iron worker at Port Neches, Texas, on the rubber plant. He also worked at Sanford, Washington at the atomic plant, also as an iron worker. We also lived in Portland, Oregon where Mr Burlingame operated a filling station at 3526 Ratton Road (SW). We then went to Eugene, Oregon, where my husband operated an auto repair shop under lease. This business was discontinued following a severe flood. N S Griggs and Son handled the funeral arrangements for the interment of my husband. My husband is survived by the following: Mrs H J Kuehl, Rt 3, Box 645, Sunnyvale, California, about 35 years of age, H V Burlingame, 125-A North Culver Street, Compton, California, age 34, and married. In addition to the surviving brother and sister, there are 4 half brothers and sisters, or rather 3 half sisters and 1 half brother. Their names are as follows: Laverne Burlingame, age 10, Wilma Burlingame, age 7, Harry Burlingame Jr, age 4, and lastly Norma Jan Eubank, age 9. The Burlingames live in Tucumcari, New Mexico with their Mother Mrs Jane Burlingame. My husband's social security number is 709-18-6555. My husband had not worked for six months prior to his death. Prior to than he operated the garage at Eugene, Oregon, located on US Highway 99, South. We were barely making expenses in the garage venture. I have the care and custody of our minor children. Robert Stevens remained at Raton, New Mexico until the Sunday following the accident under the care of Dr Adams, and was then transferred to Amarillo, under the care of Dr Robberson. The hospital bill at Raton was $31.50, while Dr Adams charged $75.00. The Northwest Texas Hospital charge was $20.76 for taking care of he child. The above expensed are partial and in no way final. I have read the above statement and hereby certify that every statement set forth in the forgoing instrument is true, to the best of my knowledge and belief. Plaintiff is an actual bona fide inhabitant of the State of Texas and has been such for 12 months continuously next preceding the filing of this petition and has been a bona fide inhabitant of Carson County for six months next preceding the fining of this petition. Defendant resides in Hutchinson County, Texas. 2. Plaintiff was legally married to Defendant, Doy Holmes, on 11 April 1952, and they have ever since been husband and wife. No children have been born of said marriage. 3. Shortly after their marriage, the Defendant commenced a course of unkind, harsh and cruel conduct toward this Plaintiff which has continued and became progressively worse until Plaintiff was finally force to separate from Defendant. During the time the parties lived together as husband and wife, the Defendant was guilty of excesses, cruel treatment and outrages toward this Plaintiff of such nature as to render their further living together insupportable. 4. There are no community property rights to be adjudicated between the parties 5. Prior to her marriage with Defendant, Plaintiff’s name was Burlingame, and Plaintiff has three children by that name; it … [remainder is missing] Judgement: On this 27 March 1953, came on to be heard the above entitled and numbered cause wherein Margaret Holmes is plaintiff and Doy Holmes is defendant, and the plaintiff appeared in person and by her attorney, but the defendant, though duly and legally cited to appear and answer herein, came not but wholly made default. A jury having been waived, all matters of fact as well as of law were submitted to the court, and the court having considered the pleadings, the evidence and argument of counsel finds that no children were born of the marriage between the plaintiff and defendant, that there are no community property rights to be adjudicated between the parties, that prior to her marriage with defendant plaintiff’s name was Burlingame, that plaintiff has three children by that name and that it would be to her best interest and to the best interest of her children that the name Burlingame be restored to her and that all of the material allegations of plaintiff’s petition are true and that all pre-requisites of the law have been complied with and that plaintiff is entitled to a decree of divorce and to have the name Burlingame restored to her. It is therefore ordered, adjudged and decreed that the bonds of matrimony heretofore existing between the plaintiff, Margaret Holmes, and the defendant, Doy Holmes, be and they are hereby dissolved, and the plaintiff is granted a divorce from the defendant. ----------------------------------------------------------------------------------------------------------------- Find a grave Margaret Howren Miller BIRTH 11 Jun 1923, Amarillo, Potter County, Texas, USA DEATH 24 Mar 2009 (aged 85), Amarillo, Potter County, Texas, USA BURIAL Llano Cemetery, Amarillo, Randall County, Texas, USA PLOT Section 20 Lot 59 Space 1H MEMORIAL ID 35769668 · View Source
