Plaintiff is an actual bona fide inhabitant of the State of Texas and has been such for 12 months continuously next preceding the filing of this petition and has been a bona fide inhabitant of Carson County for six months next preceding the fining of this petition. Defendant resides in Hutchinson County, Texas. 2. Plaintiff was legally married to Defendant, Doy Holmes, on 11 April 1952, and they have ever since been husband and wife. No children have been born of said marriage. 3. Shortly after their marriage, the Defendant commenced a course of unkind, harsh and cruel conduct toward this Plaintiff which has continued and became progressively worse until Plaintiff was finally force to separate from Defendant. During the time the parties lived together as husband and wife, the Defendant was guilty of excesses, cruel treatment and outrages toward this Plaintiff of such nature as to render their further living together insupportable. 4. There are no community property rights to be adjudicated between the parties 5. Prior to her marriage with Defendant, Plaintiff’s name was Burlingame, and Plaintiff has three children by that name; it … [remainder is missing] Judgement: On this 27 March 1953, came on to be heard the above entitled and numbered cause wherein Margaret Holmes is plaintiff and Doy Holmes is defendant, and the plaintiff appeared in person and by her attorney, but the defendant, though duly and legally cited to appear and answer herein, cam not but wholly made default. A jury having been waived, all matters f fact as well as of law were submitted to the court, and the court having considered the pleadings, the evidence and argument of counsel finds that no children were born ot the marriage between the plaintiff and defendant, that there are no community property rights to be adjudicated between the parties, that prior to her marriage with defendant plaintiff’s name was Burlingame, that plaintiff has three children by that name and that it would be to her best interest=rt and to the best interest of her children that the name Burlingame be restored to her and that all of the material allegations of plaintiff’s petition are true and that all pre-requisites of the law have been complied with and that plaintiff is entitled to a decree of divorce and to have the name Burlingame restored to her.
