WILL - dated 30 Aug 1859:
Witness: Philip S. Baldwin Witness: Asaph J. Walker "Be it remembered that heretofore, to wit on the sixth day of July A.D.1863, at Elisabethtown in the county of Essex & state of New York, before Robert Safford Hale, Esquire, Surrogate of the said county of Essex, appeared Caroline Whitney TUTTLE of the town of Essex in said county, widow of Laurtius TUTTLE, late of Essex aforesaid, farmer, deceased, & sole executrix named in the last will & testament of said deceased, & made application to have the said last will & testament relating to both real & personal estate, formed. And it being made to appear to the said surrogate that the said Laurtius died at Essex aforesaid on the 13th day of May A.D. 1863, being at or immediately previous to his death an inhabitant of the said county of Essex & the said surrogate having ascertained by satisfactory evidence the names & places of residence of the heirs & next of kin of said deceased, the said surrogate at his office in Eisabethtown aforesaid on the 20th day of July their instant & . . . . . . . .FIRST - I appoint my beloved wife Caroline W. TUTTLE guardian of my children and sole executrix to execute this my last will and testament . . . . SECOND - I give and bequeath to said Caroline TUTTLE one equal undivided one third part of those two certain lots of land in Chesterfield, Essex County, known as lots numbers one hundred and six and one hundred and eight . . . . . .THIRD - I give and bequeath unto my daughter Mary Caroline TUTTLE my Plano Forte. . . FOURTH - I will direct and empower the said Caroline W. TUTTLE to use sufficient of my person and real property to pay all my debts . . . . . . . . .FIFTH - After payment of all my debts I will and bequeath the remainder of all my property real and personal to my said wife and children in equal proportion that is to say to the said Caroline W. my wife and Arabella J. TUTTLE, Charles Edwin TUTTLE and Mary Caroline TUTTLE, my children, one fourth of all to each in equal proportion but I will and bequeath that my executrix the said Caroline W. TUTTLE shall have the possession profits use and control of all said property until said children arrive of age and shall be entitled to all the annual proceeds, rents, profits and use . . . . . . "
